Welcome to Jamiebeck.co (the "Site"), operated by Ann Street Studio LLC ("Ann Street Studio," "we," "us," or "our"), 8 The Green #24954, Dover, Delaware 19901, United States. These Terms of Use ("Terms") govern your access to and use of the Site and every service, membership, event, product, and piece of content we offer through it (together, the "Services").
By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Additional Terms
Certain Services carry their own terms, which form part of these Terms when they apply to you:
- Membership Terms, for paid memberships;
- Event & Travel Terms, for events, retreats, workshops, and trips;
- Shop Terms of Sale, for prints, lifestyle products, and other products;
- Privacy Policy and Cookie Policy, which explain how we handle personal data;
- Copyright & DMCA Policy, which governs use of our creative work.
If additional terms conflict with these Terms, the additional terms control for that Service.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to create an account, purchase, join, or book. The Services are not directed to children, and we do not knowingly collect personal data from anyone under 16.
3. Accounts
You are responsible for keeping your login credentials confidential and for all activity under your account. Please give us accurate information and keep it current. Tell us promptly kevin@jamiebeck.co if you believe your account has been accessed without permission. Accounts are personal and may not be shared, sold, or transferred.
4. Our Content and Intellectual Property
All photographs, cinemagraphs, films, writing, designs, logos, and other material on the Site (the "Content") are owned by Ann Street Studio, Jamie Beck, or our licensors and are protected by copyright, trademark, and other laws worldwide. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view the Content for your own non-commercial enjoyment. Unless we give you written permission or you have purchased a license that says otherwise, you may not:
- copy, download, screenshot for redistribution, reproduce, or republish the Content;
- remove watermarks, credits, metadata, or copyright notices;
- use the Content in advertising, merchandise, NFTs, or any commercial project;
- use the Content to train, fine-tune, or prompt any artificial intelligence or machine-learning system, or scrape or harvest it by automated means;
- frame or mirror the Site.
Sharing a link to a Site page or sharing our posts through the share tools of the social platforms on which we publish them, is welcome.
5. Member-Only Content
Content made available only to members is confidential to the membership. Members may not record, copy, forward, or publish member-only content, livestreams, or private communications, or share login access.
6. Your Content and Community Conduct
If you post comments, photographs, messages, or other material ("User Content"), you keep ownership of it. You grant us a worldwide, royalty-free, non-exclusive license to host, display, and reproduce your User Content in connection with operating the Services. We will ask before featuring your User Content in our marketing. You confirm you have the rights to everything you post. Please be kind. You agree not to:
- harass, threaten, or demean anyone, or post hateful, obscene, or unlawful material;
- post anything that infringes someone else's rights or privacy;
- share other members' personal information without their consent;
- spam, advertise, or solicit members without our permission;
- impersonate anyone or misrepresent your affiliation;
- interfere with the Site's security or operation, or upload malicious code.
We may remove User Content and suspend or end accounts that break these rules.
7. Purchases and Payments
Prices are shown in the currency displayed at checkout and may change before you buy. Payments are handled by third-party payment processors; we do not store full card numbers. You authorize us and our processors to charge your chosen payment method for every amount you agree to pay, including applicable taxes. If a price or product is listed in error, we may cancel the order and refund you in full.
8. Third-Party Links and Services
The Site may link to websites, booking platforms, or vendors we do not control. We are not responsible for their content, terms, or practices.
9. Disclaimers
The Services and Content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Site will be uninterrupted or error-free. Nothing on the Site is professional, legal, financial, medical, or travel-safety advice.
10. Limitation of Liability
To the fullest extent the law allows, Ann Street Studio and its owners, team, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose or (b) US $100. Some jurisdictions do not allow certain limitations, so these may not fully apply to you. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
11. Indemnity
You agree to indemnify and hold harmless Ann Street Studio and its owners and team from claims, losses, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Services, or your breach of these Terms.
12. Suspension and Termination
We may suspend or end your access to the Services if you breach these Terms or if required by law. You may close your account at any time. Sections that by their nature should survive termination (including 4, 9, 10, 11, 13, and 14) will survive.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Before filing any claim, please contact us at kevin@jamiebeck.co so we can try to resolve it informally within 30 days.
For customers in the United States: any dispute not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for misuse of intellectual property. You and we waive any right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration agreement by emailing kevin@jamiebeck.co within 30 days of first accepting these Terms.
For consumers outside the United States: nothing in these Terms removes protections you have under the mandatory consumer laws of the country where you live, and you may bring proceedings in the courts of that country. Otherwise, the state and federal courts located in Delaware have exclusive jurisdiction.
14. General
These Terms, together with the additional terms in Section 1, are the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
15. Changes
We may update these Terms from time to time. We will post the new version with a new effective date and, for material changes, notify account holders by email or on the Site. Continuing to use the Services after changes take effect means you accept them.
